Agree. I still blame name check 180 rule - a major decision by USCIS/FBI helped this backlogg to go from bad to worst.
Name check 180 rule -it allowed thousands of people from EB1 / EB2 Row to get their 485 cleared and consumed major chunk of 2008/09 EB visas. Had it been not there, many old timers, would have used visas as their Name check would have been cleared before them.
Oh yeah, I hear you; I personally know many of my ex-colleagues in a big IT sourcing company who came to US in L1A got their GC through EB1 category within a matter of 6-8 months.....last years 180 rule change does benefit most of these fortunate guys.....

We are one of those unluckiest ones; I changed my company 2 months before July fiasco and (EB2 PD Aug 23, '06) and never got a chance again to file I-485.
It is very frustrating (to say the least) to wait and it seems it may take another ~2 years to file I-485. It is hard on my wife in particular as she completed her masters in 2008 and narrowly lost jobs offers because companies do not wanted to H1b transfer these days.
I do not see any hope of this agony end anytime soon :(

No, this is only the processing time for labor application, the whole process took a lot longer than this. I first submitted my document to the lawyer in the last week of January this year. Lawyer prepared my case, wages approval etc. it took around 1+ month to get preventing wages. then advertisement, recruitment process etc.
almost 8 month to finish all the requirements before the company could actually file the labor application.
I hope this answers your question.

Fedup is an understatement. Zero accountability. After moving dates to 2006 now dates go back to 2003????????? Last year it started with date being at Apr 2004 and this year starts with Apr 2003????? This is beyond ridiculous!!!aaaaaaarrrghhhhhhhhhh.
P.S Its wrong to tell that guys with MS are getting their GC's before others. I have one and so do many others I know. There is no order guys...........

We should not let Cornyn down due to this bill's failure. We have to send email and thank him for bringing up this bill eventhough it failed. This will keep up his spirit and make him feel that there are people behind him even if this bill failed. This will make him to pursue other amendments in favor of legal immigrants if at all there is a slight chance before this NOV.

I mean did your employer sent you the approval copy or the Online status changed ? The reason i'm asking this question because lot of times the Online status never changes for 3-4 months from 'Pending' to 'Approved'. When did you file your EB3 140 at NSC ? i filed in May 2007 - pending for 15 months by now.
Would you mind if i ask you when you've seen the LUD change before approval ?

SO,can we all try to get the unused visas recaptured.If they can do that for nurses and physical therapists ,they can do that to decrease retrogression.I dont think they require senate approval.
