Background:
We received AOS interview letters for attending an interview at the local USCIS office next month.
Today, I received an email saying that "Notice Returned as Undeliverable" only for my spouse. We have not changed the mailing address and we are not expecting any docs from USCIS.
Question:
1. Who screwed up? Is it USPS or USCIS?
2. What notice could this be?
3. How would I resolve this (From a quick search, it appears that simply giving customer service a call will not help)
Any help is really appreciated!!

I was on H1 visa and laid off from job on 10/30/09. I got severance pay for Nov. and have the pay stubs. I applied for COS from H4 to F1 for my spouse (already in collage) and H1 to F2 for me on 12/9/09. Meanwhile immigration performed spot check at my ex-employers on 12/3/09, so they came to know that i was not working. My employer had not revoked H1 by then. Our COS application was received by USCIS on 12/14/2009, case is currently under Initial Review.
- Will the immigration officers who did spot check inform USCIS that i was out of status?
- Will case get rejected due to delay in applying for COS?
- Will there be any complications in transferring my H1 to new employer as i was out of status for about a month before i applied for COS?
- How to stop F2 COS if i get H1 transfer approved first?

I have a peculiar situation where my wife wants to apply for H1 and work after being on H4 for the last 3 years . My son who is currently on H4 wants to convert to F1 to pursue his studies . My doubt is whether I can still include them in my GC application at 485 stage whenever it happens although they were in H4 when the GC Process started.
Any suggestion / advice is highly appreciated.

Based on USCIS's last action rule, the status of an applicant depends on whatever petition is approved last. So, if her H4 is approved after her H1 COS, then she will be on H4.
I am assuming you have applied for H1/H4 extension recently in regular processing. So the chances of her H1 COS getting approved first under premium are higher. So once you get her H1 COS approval, just withdraw her H4 petition.

There has been a lot of confusion today about the so called "Frist new bill" -- it is just the Hagel-Martinez bill which was brought for a cloture vote before the Senate Easter recess. I have edited to title of the thread with the text of the bill to reflect this.

My I140 application is denied and pending appeal and I am in the proces of applying for new I140, in Part 4 section 6 is it suggested to give deatils of old I140 and if checked yes what all documents should be attached.

Current EAD was supposed to expire in Feb so applied 100 days ahead for renewal. To my surprise application got approved in 10 days:D. Hope they've given for 2 years and starting from expiry date of current one....

I am presently on Non-cap H1b(which is not counted under cap). I am planning to file for H1b thru an employer in april under MS quota with a start date of octber 2008.
My concerns are...
1. How should the new employer file H1b so that I can join at my wish after oct 2008...??
2. My present H1b is valid untill 2010. SHould I be in US while filing and untill my new H1b is approved..??? I ahve plans of visisitng india in March/aprial. So wondering If i need to visit and be back before april or is it ok to travel while my new H1b is filed using the presnet i-94..?? that is trvelling sometime In april/May..???

The USCIS announced on June 1, 2006 that the regular H-1 cap for Fiscal Year 2007 (FY2007) was reached on May 26, 2006. Those cases properly filed with the USCIS before the 26th are safe, with respect to the cap, as there are enough cap numbers for these cases. Cases that reached the USCIS on May 26th are in an uncertain situation and will be subject to a random selection process, as there are enough numbers for some, but not all of the May 26th cases. Any regular cap-subject cases received after May 26th will be rejected entirely.This information does NOT impact advanced degree cases, for which cap numbers are still available.
