Would appreciate the input on my querries by the attorneys & the people who has experienced similar situation.
My spouse's Advance Parole is expiring in mid February 2010. He is pplanning to travel to India by mid - jan & return back by 3rd feb'2010.
My questions is:
1) Is the time gap of 15 days before the expiry of the AP is safe to re-enter USA?
2) SHould he apply for the renewal of the AP before he leaves? If yes, then if the advance parole renewal approves before he re-enters the country, can he still re-enter on the old Advance Parole document or the old one gets automatically nullified?
3) Should he be in the country during the time the advance parole approves?
The situation is very urgent. Immediate feedback is highly appreciated.

Today's news that Indiana Democratic Senator Evan Bayh will be retiring is probably bad news for much of the Democrat's legislative agenda. But when it comes to immigration, this is probably a good news day. Bayh's last vote on comprehensive immigration reform was a bad one. He voted with anti-immigration Senators to filibuster the 2007 version of comprehensive immigration reform and there is little reason to believe his vote in 2010 would be different. Guys. Is this 7% country limit a hard or soft one ?. Assuming 1,40,000 total immigrant visas, India would get 7% of it and that is 9800. Then you have the preference category. Assuming there are unused immigrant visas from other countries, how do they get allocated ?. Does anyone has clear idea ?.

I had been in H-1B status and was laid off. My H-1B was withdrawn by my company on 12/31/2010. I applied for COS to B2 and received the USCIS receipt notice on Dec 17th, a few days before my H-1B was withdrawn.
Later on Feb 2nd, 2011, I received the approval notice from USCIS for B2 valid from 02/02/2011 to 04/29/2011(I had informed in my application that this would be my date of departure.) My question is: What status would I be from the date my H-1B was withdrawn till the B2 validity start date?

please advise what steps should be taken if I recieved the NL letter from KCC that I am selected for 2011 DV lottery.
I am in AOS in EB3 category, my H1B already expired, working on EAD.
My case number from DV lottery is very high (29***).
What should I choose - CP or AOS???
Should I fill and return back to KCC both forms - DSP-122 and DS-230 forms??? :confused:

I was on H1 with my previous company but laid off last week. I have !485 AOS and EAD.
I believe I can straight away join any company (consultancy or any enterprise company) on EAD , right pls ?
if get a job offer from Comapny "A" and join them today and file AC-21 today and meanwhile say I get another job from another Company "B" after two days and join them, can I file another AC-21 without waiting to hear back from USCIS. I believe AC 21 is just informational for USCIS that I have switched the jobs.

This is related to the experience letter and PERM.
I have been working with my current employer for last 3 years in software engineering role. Now I'm planning to move to program management role and planning to apply PERM from this new role.
1. To get experience letter for PERM, can I use the experience gained in my current company. What are the chances of AUDIT if I do so?
2. With my previous employer (3 yrs back) I worked in software and consulting role. Does this experience suffice for my PERM in program management role...Is it something the lawyer has to worry and not me..
