Hi
I am working on H1B and I already received my EAD and AP on november 2007. During I-484 filing I have not included my wife in my application because of personal reasons. But now i want to file it for my wife in another 2-3 months. Mu queation is that can she travel out of country on her valid H4 visa status while i travel on AP. Will it effects her reentry because I will be using my AP for travel and she dont have AP. Please answer my query.

You should change to H-4 (assuming you are eligible) if you are not working. You should be able to change back H-1B later and get the remainder of your 6 years, without being subject to the cap, if you find a new employer. It is important not to violate status now, and not working violates your H-1 status even if the lack of work is not your choice.

Yes, even primary applicant can work on EAD & 1099. But in case RFE is issued for EVL the primary applicant should have permanent full time position.

Normally, entering into the US follows the last entry rule. Thus, whatever status a person last enters on is their status.
There are special regulations when it comes to H-1b status and travelling on AP. I would speak with an attorney prior to travelling.

I have an approved I797 from last year qouta. I got a 221g when I went to stamping for my H1 visa. The 221g was regarding some documents which the employer had to provide. Subsequently I obtained a L2 visa and I am now in the US. I would now like to apply for a change of status to H1.In this regard I had the following question:
On my L2 I have applied for a EAD about 3 weeks ago. USCIS says that it could take upto 90 days to approve the same.During this time if I apply for a COS to H1, would it influence the decision making on the L2-EAD approval or they are completely separate processes?
